1. ABOUT US
Beyond Resistance is operated by Alena Borodina, a sole proprietor (Einzelunternehmerin) established in Berlin, Germany.
Throughout these Terms, the terms “Beyond Resistance,” “we,” “us” and “our” refer to Alena Borodina trading as Beyond Resistance.
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products to you.

These Terms of Service (“Terms”) apply when you visit, use or purchase products through our website and online store.
By using our Services or placing an order, you agree to these Terms together with our Privacy Policy, Refund Policy and any other policies referenced on our website.
Nothing in these Terms limits any mandatory consumer rights that apply to you under applicable law.
2. OUR PRODUCTS
We make reasonable efforts to describe and display our products accurately, including their colours, dimensions, resistance levels and other characteristics.
However, colours may appear slightly different depending on your screen, device and display settings. Minor variations between products may also occur as a result of manufacturing processes.
Product images are for illustrative purposes and should be considered together with the written product description.
Where resistance levels, measurements or other specifications are provided, reasonable manufacturing tolerances may apply.
We may update product descriptions, prices, specifications or availability from time to time and may discontinue products without prior notice.
3. PRODUCT USE AND SAFETY
Beyond Resistance products are fitness and exercise accessories and should be used only for their intended purpose.
Before each use, inspect your product for visible damage, cuts, tears or excessive wear. Do not use a product that appears damaged or compromised.
Use resistance products in a controlled manner and according to any instructions supplied with the product. Ensure that the product is securely positioned before applying tension.
Exercise involves an inherent risk of injury. You are responsible for selecting exercises and resistance levels appropriate for your abilities and physical condition.
Fitness, exercise, recovery and wellness information provided through our website, blog, social media or other channels is provided for general informational purposes only and is not medical advice or a substitute for advice from a qualified healthcare professional.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited.
4. ORDERS AND CONTRACT FORMATION
By submitting an order, you are making an offer to purchase the selected products.
After receiving your order, we may send you an automatic order confirmation acknowledging receipt of your order. This acknowledgement does not necessarily mean that your order has been accepted.
A contract between you and Beyond Resistance is formed when we expressly accept your order or send confirmation that your order has been dispatched, whichever occurs first.
We reserve the right to decline or cancel an order before acceptance, including where:

a product is unavailable;

there is an obvious pricing or product-information error;

payment cannot be authorised;

we reasonably suspect fraud or misuse; or

we cannot legally supply the product to the delivery location.
If payment has already been collected for an order that we cannot accept, we will refund the amount paid.
Please review your order carefully before submitting it.
5. PRICES, TAXES AND PAYMENT
Prices are displayed in the currency shown on the website or at checkout.
Any applicable taxes that we are required to collect will be calculated or displayed as required.
For international orders, customs duties, import taxes or other charges may apply. Where these charges are not collected by us at checkout, they may be charged separately by the relevant customs authority, carrier or other authority.
Any such charges are the customer's responsibility to the extent permitted by applicable law.
The total amount payable to us will be displayed before you complete your order.
You agree to provide accurate and complete billing, payment and contact information.
6. SHIPPING AND DELIVERY
Available shipping methods, estimated delivery periods and applicable shipping charges will be displayed on our website or during checkout.
Delivery dates and transit times are estimates unless we expressly state otherwise.
We will make reasonable efforts to dispatch orders within the timeframe communicated to you.
If an order is significantly delayed, we will provide information about the delay and, where required by applicable law, give you the option to accept the revised delivery timeframe or cancel the affected order for a refund.
We are not responsible for delays caused by circumstances outside our reasonable control, including carrier disruptions, customs processing, severe weather, strikes or other events beyond our control. This does not affect rights you may have under applicable consumer law.
Risk during delivery
For UK consumer orders, goods remain at our risk until they come into your physical possession, or the physical possession of a person you have identified to receive them, except where applicable law provides otherwise.
For customers elsewhere, risk passes at the time required by applicable law.

7. RETURNS, CANCELLATIONS AND REFUNDS
Our detailed return procedure is set out in our Refund Policy.
Unless a different period is stated on the product page or a longer period is required by law, we offer customers 14 calendar days from delivery to request a return.
Returned products should be returned in substantially the same condition in which they were received, subject to reasonable inspection of the product.
We may make an appropriate deduction from a refund where permitted by law if a product has been used or handled beyond what is reasonably necessary to inspect its nature, characteristics and functioning.
Unless the product is defective, damaged, incorrectly supplied, or applicable law requires otherwise, you may be responsible for return shipping costs as explained in our Refund Policy.
UK customers
If you are a consumer in the United Kingdom purchasing online, you generally have a statutory right to cancel an eligible purchase within 14 days after receiving the goods, without providing a reason.
After notifying us of your cancellation, you must return the goods within the period required by applicable law.
Your cancellation and refund rights are subject to any applicable legal exceptions.
Nothing in our Refund Policy or these Terms restricts rights available to UK consumers under applicable consumer law.
US customers
For customers in the United States, our 14-day return period is a contractual return policy offered by Beyond Resistance and is separate from any rights you may have under applicable federal or state law.
Nothing in these Terms limits rights that cannot legally be excluded.
8. FAULTY, DAMAGED OR INCORRECT PRODUCTS
Please contact us if you receive a product that is defective, damaged, materially different from its description or different from the product you ordered.
We may ask you to provide information or photographs reasonably necessary for us to investigate the issue.
Where you have statutory rights in relation to faulty or non-conforming goods, those rights remain unaffected by our voluntary return policy.
For UK consumers, this includes statutory rights relating to goods being of satisfactory quality, fit for purpose and as described.
Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction or refund.
9. PRE-ORDERS
Products identified as “pre-order,” “coming soon,” or similar may not be available for immediate dispatch.
Any estimated dispatch or availability date shown is an estimate unless expressly stated otherwise.
If there is a significant delay affecting a pre-order, we will notify you and provide any cancellation or refund options required by applicable law.
Any specific conditions displayed on the relevant pre-order product page form part of these Terms.
10. PERSONAL USE
Unless otherwise agreed by us in writing, products purchased through our consumer store are intended for personal or household use.
You must not purchase products through our consumer store for unauthorised commercial resale.
11. INTELLECTUAL PROPERTY
The content of our website, including the Beyond Resistance name and branding, logos, product photography, graphics, designs, text, videos and other original content, is owned by or licensed to Beyond Resistance and is protected by applicable intellectual property laws.
You may access and use the website for your personal, non-commercial use.
You may not reproduce, commercially distribute, modify, republish or exploit our content without our permission, except where permitted by law.
Third-party names, trademarks and content remain the property of their respective owners.
12. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to, integrations with or services provided by third parties.
We are not responsible for the content, availability or practices of independent third-party websites or services.
Your use of third-party services may be subject to their own terms and privacy policies.
13. SHOPIFY
Our store is hosted using Shopify.
Shopify provides the ecommerce technology that enables our online store to operate, but products purchased from our store are sold by Beyond Resistance / Alena Borodina, not by Shopify.
Your relationship with Shopify in connection with its own services may also be governed by Shopify's applicable terms and privacy policies.
14. PRIVACY
We process personal information in accordance with our Privacy Policy.
Because our store uses Shopify and other service providers, certain personal information may be processed by third parties that provide services necessary to operate our website, process payments, fulfil orders and provide customer support.

15. FEEDBACK AND REVIEWS
If you voluntarily provide us with a review, suggestion, comment, photograph or other feedback (“Feedback”), you confirm that you have the right to provide that Feedback.
You grant us permission to use, reproduce and display Feedback for the operation and promotion of Beyond Resistance, including on our website and social media, to the extent permitted by applicable law.
We will not falsely attribute statements to you or materially alter a review in a misleading manner.
You must not submit Feedback that infringes the rights of another person, contains unlawful material or is deliberately false or misleading.

You may not use our website or Services:

Information relating to fitness, exercise or wellness is provided for general informational purposes and should not be relied upon as personalised medical or professional advice.
18. LIABILITY
Nothing in these Terms excludes or limits:

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or losses resulting from use of a product contrary to the instructions or its intended purpose.
If you are purchasing as a consumer, nothing in these Terms is intended to exclude liability where doing so would be unlawful.
Different legal limitations may apply depending on your country or, for US customers, your state. Any limitation in these Terms applies only to the maximum extent permitted by applicable law.
19. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for a failure or delay in performing an obligation where the failure or delay results from circumstances outside our reasonable control.
Where such circumstances materially affect your order, we will communicate with you and take reasonable steps to minimise disruption.
Any mandatory cancellation, refund or other consumer rights remain unaffected.
20. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply only to the extent legally permitted.
The remaining provisions will continue in effect.
21. NO WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
22. CHANGES TO THESE TERMS
We may update these Terms from time to time, for example to reflect changes to our business, Services or applicable legal requirements.
The version applicable to your purchase will generally be the version in effect when you place your order.
The latest version will be available on our website with its effective or last-updated date.
23. GOVERNING LAW AND CONSUMER RIGHTS
These Terms and contracts entered into with Beyond Resistance are governed by the laws of Germany, subject to mandatory consumer-protection rules that may apply to you.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that you are entitled to under applicable law.
Nothing in these Terms requires a consumer to bring proceedings exclusively in Germany where applicable law gives the consumer the right to bring proceedings elsewhere.
UK consumers retain any mandatory rights available to them under applicable UK consumer law.
US consumers may also have rights under applicable federal and state laws that cannot be waived by these Terms.
